This website is operated by Perforated Pool Fencing ("we", "us", "our"). By visiting safestpoolfence.com.au or purchasing from us, you agree to be bound by these Terms and Conditions, together with our Privacy Policy, Returns Policy and Delivery information. If you do not agree, please do not use this site. We may update these Terms at any time by posting changes here; continued use of the site after changes are posted constitutes acceptance.
By agreeing to these Terms you confirm you are at least the age of majority in your state or territory. You may not use our products or this site for any unlawful purpose, and you must not transmit viruses or destructive code. Breach of these Terms may result in immediate termination of your ability to order from us.
Our products are imported from China and sold at imported-product prices. As disclosed on every product page: cast aluminium components will probably show signs of corrosion in time; the edges of perforation holes and cut edges are sharp; products arrive requiring assembly, and cutting panels down is a fiddly job; the colour range is Satin Black and Monument Satin only. By ordering, you acknowledge these disclosed characteristics. These disclosures form part of the description of the goods for the purposes of the Australian Consumer Law. This site does not sell Pool Perf®.
We reserve the right to refuse service or any order to anyone for any reason at any time, including orders we believe are placed by dealers, resellers or distributors. You agree not to reproduce, duplicate, copy, sell or exploit any portion of this site or its content without our express written permission.
We work hard to keep this site accurate but do not guarantee that all information is complete or current. Colours in photographs may differ from the actual product depending on your screen. Product images may be supplier or lifestyle images of the same imported product range. We reserve the right to correct errors, inaccuracies or omissions, and to change or update information or cancel orders if information (including pricing) is inaccurate at any time, including after you have submitted an order.
All prices are in Australian dollars and include GST unless stated otherwise. Prices are subject to change without notice. We may modify or discontinue any product at any time. We shall not be liable to you or any third party for any price change or product discontinuation.
You agree to provide current, complete and accurate purchase information for all orders. We may limit or cancel quantities purchased per person, per household or per order. If we change or cancel an order we will attempt to notify you via the email provided at the time of ordering.
Delivery options, costs and timeframes are set out on our Delivery & Pickup page and form part of these Terms. Bulky items are delivered by truck at a flat metro rate or collected from a nominated depot; small items are couriered with shipping calculated at checkout (minimum charge $25 per order). If collecting goods, you must ensure you have suitable transport — the depot may refuse to load unsuitable vehicles. Please check you have been given the correct items before leaving the premises; costs associated with swapping incorrectly taken goods are not our responsibility. Any actual or suspected transit damage must be reported to us within 24 hours of receipt.
Our Returns Policy forms part of these Terms. In summary: change-of-mind returns are not accepted; remedies for damaged, defective or incorrectly supplied goods are provided in accordance with the Australian Consumer Law.
There is no manufacturer warranty on our products. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law — you are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality. Acceptable quality is assessed having regard to the nature and price of the goods and the disclosures made on each product page.
This site contains links to third-party websites, including Pool Perf®. We are not responsible for the content or accuracy of third-party websites and are not liable for any harm or damages related to transactions with third parties. Review their policies before transacting.
Your submission of personal information through this site is governed by our Privacy Policy.
You must not use this site or its content: for any unlawful purpose; to solicit unlawful acts; to violate any laws or regulations; to infringe our or others' intellectual property; to harass, abuse or discriminate; to submit false information; to upload malicious code; to collect personal information of others; to spam, phish, spider, crawl or scrape; or to interfere with the security of this site. We may terminate your use of the site for violating any prohibited use.
To the maximum extent permitted by law, and subject always to the Australian Consumer Law: we do not guarantee that your use of this site will be uninterrupted or error-free; the site and products are provided on an 'as is' and 'as available' basis; and in no case shall Perforated Pool Fencing, its related entities, directors, employees, agents or suppliers be liable for any indirect, incidental, punitive, special or consequential damages, including lost profits or replacement costs, arising from your use of the site or products. Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law, including (where permitted) resupply of the goods or the cost of resupply.
You agree to indemnify and hold harmless Perforated Pool Fencing and its related entities, officers, agents and employees from any claim or demand, including reasonable legal fees, made by any third party due to your breach of these Terms or your violation of any law or the rights of a third party.
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision remains enforceable to the fullest extent permitted by law, and the remainder of these Terms remains valid and enforceable.
These Terms are effective unless terminated by you or us. Obligations incurred before termination survive it. We may terminate this agreement without notice if you fail to comply with any of its terms, and you will remain liable for amounts due up to the date of termination.
These Terms, together with the policies referenced in them, constitute the entire agreement between you and us and supersede any prior agreements. Our failure to enforce any provision is not a waiver of it. Ambiguities shall not be construed against the drafting party.
These Terms and any separate agreements under which we provide products are governed by and construed in accordance with the laws of Queensland and the Commonwealth of Australia.
